Terms of Service

1. Description of Service

PinFeed is an in-context web feedback tool that allows teams to drop visual pins on any web page, leave comments, and push issues to third-party project management tools including GitHub, Linear, and Jira. The Service consists of a browser extension, a web dashboard, and server-side components.

2. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

To use certain features of the Service, you must create an account using an email address and password or through a supported OAuth provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

4. Subscriptions and Billing

PinFeed offers both free and paid subscription plans. Paid plans are billed monthly or annually through Stripe, our payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

• Cancellation. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds. Payments are non-refundable except where required by applicable law or at our sole discretion. If you believe you are entitled to a refund, please contact us.
• Price changes. We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to scrape, crawl, or extract data from the Service
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Harass, abuse, or harm other users through the Service
• Upload or transmit malicious code, viruses, or any harmful content

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by LionByte Software SRL and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features without prior written consent.

7. Your Content

You retain ownership of all content you create through the Service, including feedback pins, comments, screenshots, and annotations ("User Content"). By using the Service, you grant us a limited, worldwide, non-exclusive license to store, display, and process your User Content solely for the purpose of providing and improving the Service.

You are responsible for ensuring that your User Content does not violate any third-party rights or applicable laws. We do not monitor User Content but reserve the right to remove content that violates these Terms.

8. Third-Party Integrations

The Service allows you to connect with third-party services such as GitHub, Jira, and Linear. Your use of these integrations is subject to the respective terms and privacy policies of those services. We are not responsible for the availability, accuracy, or practices of third-party services. You authorize us to transmit your data to connected third-party services as necessary to provide the integration features you have enabled.

9. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LionByte Software SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania. Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws of your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
